Local roads

Where Diamond Bar crashes happen

Diamond Bar is a hillside city built around two freeways. Almost every trip touches the 57, the 60, or one of the few arterials that connect the neighborhoods to them. Where the crash happened decides who wrote the report and what evidence might exist. These are general patterns from the kinds of cases we see, not statistics.

The confluence is a work zone

Caltrans and the City of Diamond Bar have been rebuilding the 57/60 interchange for years, and lanes, ramps and barriers change as the work moves. If a missing sign, a bad lane shift or debris helped cause your crash, a public agency or a contractor may share the blame. Claims against the State have a six-month deadline. The city keeps a project page.

What to do after a car accident in Diamond Bar

StepDoDon’t
SafetyCall 911 if anyone is hurt. On the freeway, get to the shoulder or off at the next exit if the car can move.Stand between cars or in a live lane to take pictures.
ReportGet the report number from CHP or the Sheriff’s deputy. If nobody came, report it to the Walnut/Diamond Bar Station.Agree to “just exchange info” after a crash where someone feels hurt.
EvidencePhotograph both cars, plates, the lanes, signals, debris and your injuries. Get every witness’s name and number.Assume the officer will collect witness contacts for you.
MedicalGet checked the same day or the next. Pomona Valley Hospital Medical Center in Pomona has a 24-hour ER and trauma care.Wait a few weeks to see if the pain goes away. Gaps in care get used against you.
DMVFile the SR-1 with the DMV within 10 days if anyone was hurt or damage is over $1,000.Assume the police report takes care of it. It does not.
InsuranceTell your own insurer the basic facts.Give the other driver’s insurer a recorded statement or sign their forms.
Comparison 2

What the insurance adjuster does vs. what your lawyer does

Adjusters are not villains. They are paid by the insurance company to close claims for as little as the facts allow. Here is how the same moment looks from each side.

MomentThe other driver’s adjusterYour lawyer
First callAsks for a recorded statement while you are still sore and confused.Takes the call for you and gives only what the claim needs.
FaultLooks for any reason to assign you a share of the blame.Gathers the report, video, photos and witnesses to show what happened.
Medical recordsWants a broad authorization to dig through years of your history.Sends the records that relate to the crash, and no more.
Your carWrites a low estimate or a low total-loss value.Challenges the estimate, the parts and the valuation, and claims diminished value where it applies.
The offerMakes an early offer before you know how hurt you are.Waits until the injury is understood, then sends a full demand.
If talks stallWaits you out, knowing the two-year deadline is running.Files suit in LA Superior Court before the deadline and keeps the pressure on.
Comparison 3

Handling the claim yourself vs. hiring an attorney

Some claims really are small enough to handle on your own, and we will tell you when yours is one of them. Here is the honest trade-off.

On your ownWith Morales Law Firm
CostNo fee, but you carry all the time and stress. No fee unless we recover. Nothing up front.
Finding coverageYou see the at-fault driver’s policy and maybe your own.We look for every policy: the driver, the owner, an employer, rideshare, your UM, UIM and MedPay.
TreatmentYou may skip care you cannot afford up front. If needed, we connect you with doctors who wait to be paid from the case.
Medical bills at the endYou pay what providers and health plans ask.We negotiate liens and balances down before you are paid.
DeadlinesEasy to miss the six-month government claim or the two-year lawsuit date.We calendar and meet them.
Who you talk toA rotating set of adjusters.Attorney Francisco Morales, directly, in English or Spanish.

For a scrape with no injury, small claims court may be enough. In California, individuals can sue for up to $12,500 there.

Comparison 4

The at-fault driver’s coverage vs. your own UM, UIM and MedPay

California is a fault state, not a no-fault state. The driver who caused the crash is responsible, and their insurer pays first. Under pure comparative fault (Li v. Yellow Cab Co.), your recovery is reduced by any share of blame you carry, but not erased. One exception: under Proposition 213 (Civil Code section 3333.4), an uninsured driver generally cannot recover pain and suffering, though medical bills and lost wages are still recoverable.

CoverageWhose policyWhat it paysWhen it matters
Bodily injury liabilityThe at-fault driver’sYour injuries, lost wages, pain and suffering, up to their limitsEvery case. The California minimum is $30,000 per person and $60,000 per accident, effective January 1, 2025.
Property damage liabilityThe at-fault driver’sYour car, rental, towing, other propertyThe minimum is $15,000, which may not cover a newer car.

Damages

What a Diamond Bar car accident claim can recover

Nobody can honestly put a number on a case the first week. Value depends on the injuries, the treatment, the effect on your life, and how much insurance is available. The categories California law allows are:

Economic lossesNon-economic losses
Ambulance, ER, imaging, doctor visitsPhysical pain
Therapy, chiropractic, injections, surgeryAnxiety, lost sleep, fear of driving
Future medical careLoss of the activities you enjoyed
Lost wages and lost earning capacityStrain on family life
Car repair or value, rental, towing, diminished valueScarring and permanent limits
Deadlines

The dates that matter

DeadlineWhat it is for
10 daysDMV SR-1 report if anyone was hurt or damage is over $1,000
6 monthsGovernment claim if a public vehicle, a transit bus or a dangerous public road played a part (Gov. Code § 911.2)
2 yearsInjury lawsuit (Code Civ. Proc. § 335.1)
3 yearsProperty damage lawsuit (Code Civ. Proc. § 338)

A claim against a private construction contractor follows the normal two-year rule, but if the State or the city may share fault, the six-month clock controls that part of the case.

Questions

Diamond Bar car accident questions

Who takes the report after a car accident in Diamond Bar?

Diamond Bar contracts with the Los Angeles County Sheriff’s Department, so crashes on city streets are handled by the Sheriff’s Walnut/Diamond Bar Station. Crashes on the 57 and the 60 are handled by the California Highway Patrol through its Baldwin Park Area office.

Where would a Diamond Bar car accident lawsuit be filed?

Diamond Bar is in Los Angeles County. A lawsuit from a Diamond Bar crash is usually filed in Los Angeles Superior Court at Pomona Courthouse South, 400 Civic Center Plaza in Pomona. Most cases settle without a trial.

I was hurt in a crash in the 57/60 construction zone. Who is responsible?

Usually the driver who caused the crash. If a lane shift, missing sign, debris or another road condition helped cause it, a public agency or a construction contractor may share responsibility. A claim against a public agency must generally be filed within six months, so call early.

A truck hit me on the 60. Is that different from a regular car accident?

Yes. A commercial truck usually has a larger insurance policy and its own investigators, and important evidence such as the truck’s electronic logs, engine data and camera footage can be lost if no one asks for it to be preserved. We send preservation letters right away.

How long do I have to file a claim after a car accident in California?

Generally two years from the crash for an injury lawsuit and three years for property damage. If a government vehicle or a dangerous public road was involved, a government claim must be filed within six months.

Is California a no-fault state?

No. In California the driver who caused the crash, and that driver’s insurer, are responsible for your losses. Your own MedPay coverage can pay medical bills right away regardless of fault.

What if I was partly at fault?

California uses pure comparative fault. Your recovery is reduced by your share of the fault but not eliminated, so you can still recover even if you made a mistake too.

The other driver had only the minimum insurance. Is that all I can get?

Not always. California’s minimum is $30,000 per person. If your losses are higher, your own underinsured motorist coverage may pay the difference, and other policies may apply if the driver was working or driving someone else’s car.

Should I accept the insurance company’s first offer?

Usually not before you know the full extent of your injuries. Once you sign a release, the claim is over even if you later need more treatment. Have a lawyer review any offer before you sign.

How much does it cost to hire you?

The consultation is free and we work on contingency. There is no fee up front and no fee unless we recover money for you.
