Where crashes happen in Baldwin Park

Baldwin Park calls itself the Hub of the San Gabriel Valley, and the roads explain why. The 10 runs straight through the city, the 605 runs along its western side, and the two meet at one of the busiest interchanges in the valley. Everything getting on or off those freeways feeds onto a few main streets in a city of about 72,000 people, most of whom drive to work.

  • The 10/605 interchangeStop-and-go traffic, sudden lane changes and multi-car crashes. These are CHP cases, and they often involve several drivers telling different stories. Read more about 10 Freeway crashes and 605 Freeway crashes.
  • Francisquito Ave. and Puente Ave. near the 10Short, crowded on- and off-ramps where drivers merge, brake and cut across lanes.
  • Baldwin Park BoulevardThe city’s main north-south street, past Kaiser and the shopping centers. Left turns, driveways and pedestrians.
  • Ramona Boulevard and Maine AvenueDowntown, next to City Hall and the Metrolink station. Buses, commuters, foot traffic and people hurrying to make a train.
  • Arrow Highway and the north sideCommuters mixed with industrial and truck traffic.

Your rights after a Baldwin Park crash

Sus derechos después de un choque

EN What California law gives you

  • The careless driver pays. California is an at-fault state, so their insurer owes your medical bills, lost pay and pain and suffering.
  • Partly at fault? You can still recover. Your money is reduced by your share, not wiped out.
  • You don’t have to talk to their insurer. No recorded statement, no signing anything.
  • Immigration status isn’t part of your injury case. California’s Evidence Code section 351.2 keeps it out of personal injury lawsuits.
  • No health insurance? You can still get care from doctors who wait to be paid from the settlement.
  • You pick the body shop, not the insurance company.

Who pays: fault, insurance and the money gap

Most Baldwin Park cases come down to two questions: who caused the crash, and how much insurance is available to pay for it.

Fault. California uses pure comparative fault, a rule from the state Supreme Court’s 1975 decision in Li v. Yellow Cab Co. If you were 25% at fault for a lane change near the 605 ramps, you still recover 75% of your losses. Insurers know this, so they work hard to push a few percentage points onto you. Photos, witness numbers, dash-cam video and the cars’ event data recorders push back.

Their liability policy

California’s minimum limits are $30,000 per person, $60,000 per crash and $15,000 for property damage, as of January 1, 2025. Many drivers on the 10 carry only the minimum. Some carry nothing.

Your UM/UIM coverage

Uninsured and underinsured motorist coverage on your own policy pays when the other driver has no insurance, not enough, or drove off. In serious cases, it’s often where most of the money comes from. See uninsured motorist claims.

MedPay

Optional coverage that pays your medical bills up to its limit, no matter who caused the crash. Many people don’t know they have it. We read your declarations page on the first call.

If you didn’t have insurance. Under Proposition 213 (Civil Code section 3333.4), an uninsured driver generally can’t recover pain and suffering, though you can still recover medical bills and lost wages, and there are exceptions, such as when the other driver was convicted of DUI. Passengers aren’t affected. Call anyway. These cases are usually still worth bringing.

Hit by a driver who took off on Ramona or the 10? Your UM coverage can still pay. Read about hit-and-run claims. In an Uber or Lyft? Rideshare companies must carry $1 million in coverage from the time a ride is accepted until you get out. See rideshare accidents.

What your claim can cover

Nobody can honestly tell you what your case is worth in the first week. It depends on your injuries, how long you treat, the work you miss, how the crash changes your daily life, and how much insurance is out there. These are the categories California law allows:

Money you lost

  • ER, doctor, therapy and surgery bills
  • Future medical care
  • Lost wages and lost earning capacity
  • Car repair or replacement, rental and towing

Harm that isn’t on a receipt

  • Pain, now and later
  • Emotional distress and fear of driving
  • Loss of enjoyment of daily life
  • Scarring or permanent limits

What hurts a claim: waiting to see a doctor, gaps in treatment, a recorded statement, and social media posts. The first offer is rarely the real number. Here’s why the first settlement offer is low.

Your car: a lawyer who knows repair estimates

Before law school, I worked as a certified automotive service consultant. When the insurer sends an estimate or a total-loss number, I check for aftermarket parts, skipped sensor calibration, hidden damage, low comparable cars and diminished value. You have three years to sue over property damage, but rental coverage runs out much sooner.

Deadlines you can’t miss

Plazos que no puede dejar pasar

EN California deadlines

  • 10 days: DMV SR-1 report if anyone was hurt or damage is over $1,000.
  • 6 months: claim against a government agency, such as a city vehicle, a Foothill Transit bus, a Metrolink train, or a dangerous public road (Government Code section 911.2).
  • 2 years: injury lawsuit against the driver (Code of Civil Procedure section 335.1).
  • 3 years: lawsuit for damage to your car (Code of Civil Procedure section 338).

Where a lawsuit would be filed. If your case needs a lawsuit, a Baldwin Park crash is typically filed in the Los Angeles Superior Court’s East District, at the Pomona Courthouse South. Most cases settle before trial. If you want to read up on how the process works, the California Courts self-help guide is a good place to start, and the LA Superior Court lists every courthouse.

Baldwin Park car accident questions

Who writes the police report for a car accident in Baldwin Park?

The Baldwin Park Police Department handles crashes on city streets. Crashes on the 10 or the 605 are handled by the CHP Baldwin Park Area office, which is located in the city on Francisquito Avenue. We request the report for you.

¿Hablan español?

Sí. El abogado Francisco Morales es completamente bilingüe y maneja todo el caso en español si usted lo prefiere, desde la primera llamada hasta el acuerdo final.

How far is your office from Baldwin Park?

Our office at 151 W. Bonita Ave. in San Dimas is about 20 minutes east on the 10, depending on traffic. We also meet clients at home or in the hospital.

Can I make a claim if I don’t have immigration papers?

Yes. Your right to recover for injuries caused by a careless driver doesn’t depend on immigration status, and California Evidence Code section 351.2 keeps immigration status out of personal injury cases.

The driver who hit me had no insurance. What now?

If your policy includes uninsured motorist coverage, you can make a claim with your own insurer, which has to handle it fairly. We check your declarations page on the first call and look for any other coverage that applies.

I was hit by a Foothill Transit bus or near the Metrolink station. Is that different?

It can be. Claims against public agencies usually require a written government claim within six months of the crash (Government Code section 911.2), much sooner than the normal two years. Call right away.

How long do I have to file a claim after a Baldwin Park crash?

Two years for an injury lawsuit, three years for property damage, and six months for a claim against a government agency. The DMV SR-1 report is due within 10 days.

How much does a Baldwin Park car accident lawyer cost?

Nothing up front. We work on a contingency fee, a percentage of the recovery paid only when the case resolves. No recovery, no attorney fee. The consultation is free.

¿Puedo recibir tratamiento médico si no tengo seguro?

Sí. Trabajamos con doctores, quiroprácticos y centros de imágenes que lo atienden ahora y cobran del acuerdo al final del caso, sin pagos de su bolsillo.

Should I give the insurance company a recorded statement?

No. You aren’t required to, and it will be used to reduce your claim. Report the crash to your own insurer briefly and factually, and send the other insurer to us.

Talk to an attorney before you talk to the insurance company.
